4. PAYMENT METHOD
"CopyThinking" or the Payment provider may be required to add taxes to the billing rate as detailed, if applicable, before the payment process. Payments for the Training are non-refundable, and no refunds or credits will be provided for partially used periods unless required by applicable law.
Participants will be able to pay for the Training using the following payment method: Stripe. Participants understand and accept that Stripe is a third-party service provider; therefore, "CopyThinking" is not responsible for the service of payment processing.
To proceed with payment, participants will access the environment controlled by the payment service provider (redirected outside of the Training platform and not controlled by "CopyThinking").
Given that payment is made in an environment outside the Training, participants declare to be aware that any questions or eventualities related to this process must be directed to the payment service provider, Stripe, in accordance with their terms and conditions, and not to "CopyThinking", which has no control over the payment tools and does not handle the data that participants provide to make payments.
5. USE OF THE PLATFORM
"CopyThinking" grants participants a limited, non-exclusive, non-sublicensable, non-transferable, and revocable license to use, visualize, and where applicable, download the content that is part of the Training, solely for personal and non-commercial purposes. The use of the Training shall always be personal and in accordance with these Terms and Conditions.
The use of the Training for purposes other than those set out in these Terms and Conditions is expressly prohibited.
"CopyThinking" may provide access to a variety of texts, graphics, videos, and other materials belonging to "CopyThinking" or third parties, to which participants may have personal and non-transferable access. Participants assume responsibility for the use of the Training and undertake to make lawful, diligent, honest, and correct use of any information or content accessed, respecting the principles of good faith and the law.
Conditions of Use:
Participants undertake to use the Training diligently, legally, and in accordance with these Terms and Conditions. This includes not using the Training in any way that could prevent, damage, or impair its normal operation and enjoyment by other participants. Without limitation, participants agree not to use such Content or Services to:
(i) Unauthorized or fraudulent use of the Training or its content;
(ii) Access or attempt to access restricted resources of the Training ;
(iii) Use the Training for unlawful, illegal, or harmful purposes;
(iv) Cause damage to the Training or systems of other participants or third parties;
(v) Reproduce, copy, distribute, transform, or modify contents without authorization;
(vi) Introduce or spread computer viruses or harmful systems;
(vii) Obtain content by means other than those provided by the Training;
(viii) Send spam, advertisements, or repetitive messages without consent.
"CopyThinking" reserves the right to investigate and report any misconduct in accordance with the law and to cooperate with authorities. It also reserves the right to deny access or terminate accounts in cases of improper use.
6. TERMINATION REGISTRATION
Participants have the right to cancel their registration for 1-of-1 Personal Brand" Training at any time. However, due to the nature of the one-time registration, any cancellation will not result in a refund. As the Training offers immediate access to its content, payments are non-refundable, and no refunds or credits will be provided for partially used access unless required by applicable law.
The right of withdrawal shall not apply once the participant has accessed the Training content, in line with Article 103 a) of Spanish Royal Legislative Decree 1/2007, of November 16, 2007, which approves the revised text of the General Law for the Defense of Consumers and Subscribers, and other European complementary laws.
7. INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS
All content and materials of "1-of-1 Personal Brand" Training, including but not limited to, its programming, content, designs, logos, texts, graphics, and recordings, are the property of "CopyThinking". Participants acknowledge that any reproduction, modification, distribution, commercialization, decompilation, disassembly, or use of reverse engineering techniques to obtain source code, or any unauthorized use of the Training's content, constitutes an infringement of intellectual property rights.
Unauthorized use of the Training 's content will be considered a serious breach of intellectual or industrial property rights and may lead to legal responsibilities.
For any use of the Training 's content, prior, express, and written authorization from "CopyThinking" is required. Designs, logos, texts, and graphics not owned by "CopyThinking" that appear in the Training are the property of their respective owners.
Participants agree that any suggestions, comments, ideas, or feedback provided to "CopyThinking" become the exclusive property of "CopyThinking" and can be used, modified, or published without compensation to the participant.
8. UPDATES
"CopyThinking" reserves the right to modify, suspend, and/or interrupt, temporarily or permanently, the services offered through the Training, with or without prior notice, and without any liability to participants.
"CopyThinking" may make updates and enhancements to the functionality or features of the Training, including security patches, bug fixes, and other modifications. These updates may change, add, or remove features.
Participants agree that "CopyThinking" is not obligated to provide updates or to maintain any particular features or functionality. All updates are considered part of the Training and are subject to these Terms and Conditions.
9. LIABILITY AND WARRANTIES
9.1 General Liability
"CopyThinking" does not offer any guarantees and is not responsible for damages that may arise from accessing or using the Training's content. This includes any indirect, incidental, special, consequential, or punitive damages arising out of or related to the Training.
9.2 Suspension and Cancellation of Services
"CopyThinking" may temporarily suspend access to the Training for maintenance, repair, updating, or improvement operations without prior notice. In such cases, "CopyThinking" aims to minimize the impact on participants but is not liable for any inconvenience or loss that may occur due to these interruptions.
"CopyThinking" reserves the right to limit or prevent access to the Training in the event of technical difficulties or unforeseen circumstances that compromise the security or operation of the Training. In such cases, "CopyThinking" is not responsible for the lack of availability or continuity of the Training.
In cases where services are canceled or suspended for reasons not attributable to "CopyThinking" it will strive to resolve issues and provide necessary support to participants to ensure a satisfactory resolution.
9.3 Force Majeure
"CopyThinking" shall not be liable for any failure to perform due to unforeseen circumstances or causes beyond its control, including natural disasters, acts of government, power failure, or other disruptions affecting the internet or the technology infrastructure.
9.4 Hyperlinks and Third-Party Content
If the Training includes hyperlinks to third-party platforms or websites, "CopyThinking" is not responsible for the content, information, or services provided on these external platforms. These links are provided for informational purposes only and do not imply endorsement.
Should "CopyThinking" become aware of any unlawful or damaging content in the linked external sources, it will act diligently to remove or disable the link as soon as possible.
10. INDEMNITY
Participants shall indemnify and hold "CopyThinking" harmless from all damages, liabilities, and expenses arising from third-party claims against "CopyThinking". This includes, but is not limited to, legal fees incurred as a result of misuse of the Training's services or violation of these Terms and Conditions.
"CopyThinking" will promptly notify participants of any such claims, actions, or proceedings using the contact information provided at the time of registration. By accepting these Terms and Conditions, participants acknowledge that "CopyThinking" holds no liability in relation to the services contracted between the participant, "CopyThinking" and third parties.
11. DATA PROTECTION
"CopyThinking" respects the privacy of its Users and will ensure that personal data is processed in accordance with current legislation.
"CopyThinking" guarantees the security and confidentiality of the personal data provided by Users in compliance with the provisions of Regulation 2016/679 of 27 April 2016 on the protection of individuals with regard to the processing of personal data and the free movement of such data (hereinafter "GDPR") and other applicable privacy legislation.
In this regard, Participants and Users not yet Registered are informed that, with regard to privacy and the protection of their personal data, they may exercise the following rights:
i. Access to their personal data;
ii. Request the rectification of any inaccurate data;
iii. Request the deletion of their data;
iv. Request the restriction or limitation of the use of their personal data;
v. Oppose the processing of their data;
vi. Object to the processing of your data;
vii. Exercise your right to be forgotten;
viii. Request the portability of their data. Subscribers shall also have the right not to be subject to decisions based solely on automated data processing.
We inform you that you can exercise your rights of access, rectification, erasure, opposition, limitation of processing, portability, forgetfulness and not to be subject to automated individual decisions by sending an e-mail to george@grammarhippy.com
12. APPLICABLE LEGISLATION AND JURISDICTION
For the resolution of any discrepancy, question or claim arising directly or indirectly from the interpretation or execution of these Terms and Conditions, the parties waive any jurisdiction that may correspond to them and submit to the jurisdiction of the Courts and Tribunals of the city of the Subscriber's domicile.
Pursuant to the provisions of Regulation (EU) No 524/2013 of the European Parliament and of the Council of 21 May 2013 on the settlement of consumer disputes online, "CopyThinking" informs you that, in the event of a dispute, Users resident in the European Union may use the "Online Dispute Resolution Platform" developed by the European Commission, in order to attempt to settle out-of-court any dispute arising from the provision of services by "CopyThinking".
